The Nickelodeon Film Club Terms and Conditions:

This AGREEMENT (the “Agreement”) sets forth the terms and conditions of membership of The Nickelodeon Film Club (the “Club”) and is made between Natl. Amusements (UK) Limited (Company registration number 02141131) of Redfield Way, Lenton, Nottingham NG7 2UW and you as the parent or legal guardian (“You”) of each child You give consent to enrol in the Club (a “Member”).

Members will be able to profit from certain benefits (see Benefits section below) redeemable at Natl. Amusements (UK) Limited’s chain of cinemas known as Showcase Cinemas.

Members must be fifteen (15) years or younger to be eligible for membership. By accepting membership for Your child or children into the Club, You (on behalf of Yourself and Your child or children) agree to be bound by this Agreement, our Privacy Policy and all Terms and Conditions found on this Website and as they may, from time to time, be amended, without further action.

Any conflict between this Agreement and any other terms and conditions on this Website shall be construed in favour of this Agreement.

MEMBERSHIP - There is no purchase necessary for Club membership. All eligible prospective Club Members must provide their name, address, age, their email address and an email address for their parent(s) or legal guardian(s) so that Natl. Amusements (UK) Limited can contact them to obtain consent to membership. Natl. Amusements (UK) Limited will contact the parent(s) or legal guardian(s) via the email address provided and request acceptance of the child’s membership. Upon receipt of Your consent Your child will become a Member of the Club.

Members of the Club may be required to show proof of age before redeeming any benefit. Natl. Amusements (UK) Limited may, in its sole discretion, and at any time, disqualify a Member and cancel a membership for failure to provide proof of age.

Natl. Amusements (UK) Limited will use its reasonable endeavours to issue a membership card via the post within thirty (30) days of receiving parental or guardian consent. Natl. Amusements (UK) Limited shall not be responsible for the loss of or damage to any membership cards. Only one (1) membership card is allowed per child, and a person submitting more than one (1) application is subject to membership cancellation. The Club membership card will have to be presented in order to participate in certain Club promotions or events.

BENEFITS – Every Member will receive the following as part of their membership:

Members will also receive notification from time to time of special Club activities, events and programs, together with notification from time to time of certain discounts or offers from Natl. Amusements (UK) Limited.

If, due to circumstances beyond Natl. Amusements (UK) Limited’s control, Natl. Amusements (UK) Limited is unable to provide the stated Nickelodeon goody bag, Natl. Amusements (UK) Limited reserves the right to provide a substitute.

FURTHER TERMS IN RESPECT OF THE PASS - The Pass may be redeemed for one standard entry to a scheduled performance of a film at any participating Showcase Cinema subject to the following conditions:

  1. Due to contractual obligations this admission Pass may not be valid for all films. Patrons are advised to check with their chosen cinema before visiting.
  2. The Pass is subject to BBFC film classification restrictions and Showcase general terms and conditions. Patrons must be eligible to see their chosen movie. Proof of age may be required.
  3. The Pass cannot be exchanged for cash or any other product.
  4. The Pass does not give the bearer priority over other patrons.
  5. Showcase regrets that the Pass cannot be used for bookings other than those made in person at the theatre box office.
  6. Passes will be validated by Showcase staff on redemption. Valid Any Time

POSSIBLE FUTURE CHANGES OR TERMINATION – Natl. Amusements (UK) Limited reserves the right to change the terms and conditions of this Agreement at any time upon notice. Natl. Amusements (UK) Limited also reserves the right to terminate, in whole or in part, the Club and cancel this Agreement at any time upon written notice to Members and in such event Natl. Amusements (UK) Limited shall have no further obligation hereunder. Any notice to be given under this provision will be placed on the Club Website.

USE OF INFORMATION – You will be asked to provide Your child’s name, address, telephone number, e-mail address, gender and age when You enrol Your child in the Club (collectively, the “Information”). In providing the Information You consent to Natl. Amusements (UK) Limited using the Information to operate and administer the Club.

The Information also will be used to communicate with the Member about Club activities, events and programs, and about discounts or offers made available specifically to Club Members that may be of interest. The Member will also be given the chance to opt-in to receiving the Nick Insider email update service. The Member may opt-out of receiving any such emails at any time by following the instructions given in such emails.

Natl. Amusements (UK) Limited WILL share the Information with Nickelodeon UK Limited as they participate in the management of the Nickelodeon Film Club.

Natl. Amusements (UK) Limited will NOT share the Information with any third party, other than Nickelodeon UK Limited, unless it is for the sole purpose of administering the Club.

CHANGE OF DETAILS – You must inform Natl. Amusements (UK) Limited of any changes to the Information as and when such changes occur.

LIABILITY – Natl. Amusements (UK) Limited shall not be liable for any delay in performing or partial or total failure to perform any of its obligations under these Terms And Conditions if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation, war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes arising without limitation out of or in connection with the activities of third party event organisers, or any form of transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or cars).

For the avoidance of doubt, the Member (and/or any guests and/or parents/guardians) shall be solely liable for any additional costs incurred as a result.

Natl. Amusements (UK) Limited shall not be liable to the Member and/or any guests and/or parents/guardians for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the Club other than death or personal injury caused by negligence of Natl. Amusements (UK) Limited and/or Natl. Amusements (UK) Limited’s personnel and/or deceit or fraud by Natl. Amusements (UK) Limited and/or Natl. Amusements (UK) Limited’s personnel.

MISCELLANEOUS - This Agreement contains the entire understanding and supersedes all prior understanding of the parties relating to the Agreement, and cannot be changed or terminated orally. If any provision of this Agreement is found to be illegal or unenforceable, the Agreement will be deemed curtailed to the extent necessary to make it legal and enforceable and will remain, as modified, in full force and effect.

A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

This Agreement, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with the laws of England and the parties consent to the irrevocable jurisdiction of the English courts. Your statutory rights are not affected.

COMPETITIONS - NATL. Amusements (UK) Ltd. of Redfield Way, Lenton, Nottingham, NG7 2UW, is the promoter of the competition (“Promoter”). These standard competition terms and conditions (“Terms And Conditions”) will apply to all of the Promoter’s competitions administered through its Nickelodeon Film Club program unless otherwise stated. Depending on the nature of the competition, it may be necessary to have additional terms and conditions (“Additional Terms and Conditions”), which will take priority over these Terms And Conditions. The Promoter shall notify the entrants of any Additional Terms and Conditions that may apply to a competition.

Entrants may enter the competition by following the directions given in respect of each competition.

  1. Closing Date: The closing date shall be the date and/or time given in the instructions for the competition and unless otherwise stated, entries must be received by the Promoter on the closing date by the following times:
    1. Midnight GMT for entries by email and/or online;
    2. 5 pm GMT for entries by post
  2. Competitions are open to UK residents only, excluding employees of the Promoter, relatives of employees of the Promoter or of its respective parent, subsidiary or affiliated companies, its agents or any other person connected to the competition.
  3. Age Restrictions: Unless otherwise stated in the Additional Terms and Conditions, the following age restrictions will apply to this competition as promoted by the Promoter:
    1. For competitions on the Showcase web site: Entrants must be aged 15 or under to enter.
    2. For competitions on in Showcase Cinemas locations and/or on its premises: Entrants must be aged 15 or under to enter.
  4. All entrants must obtain parental consent prior to entering competitions.
  5. One entry per household per competition.
  6. To give all entrants a chance of winning a prize, a maximum of one prize per household is permitted within a 4-week period.
  7. Entrants must provide the details requested by the Promoter, which may include entrant’s name, date of birth, age, address (including postcode), telephone number and/or email address.
  8. For question and answer competitions, the winner will have answered the question correctly and will be the first entry randomly drawn after the closing date from all the correct entries received. For skills based competitions, such as designing and/or story writing competitions or performing challenges, the winner will have successfully completed the required skills based task and will be the person whom the Promoter judges deem to have performed such task the best from all the entries received. The Promoter’s decision is final.
  9. The judge's decision is final. No correspondence will be entered into.
  10. Prizes can only be sent to a UK address.
  11. The Promoter reserves the right to select an alternative winner and award the prize to another entrant in the event that :
    1. the Promoter has reasonable grounds for believing that an entrant has contravened any term or condition of entry;
    2. a winner has changed address to one outside of the UK after the closing date;
    3. the Promoter is unable to contact the winner within one hour of the closing date/time in respect of competitions on live or as live programming;
    4. the Promoter is unable to contact the winner within 24 hours of the closing date for competitions with prizes for a trip or event with a specific date (except than where the competition is during live or as live programming in which case (c) above will apply);
    5. the winner’s parents/guardians do not agree to these terms and conditions and/or do not wish their child to receive the prize; or
    6. the Promoter does not receive confirmation of the winner’s address and/or parental/guardian consent as may be requested within 14 days.
  12. Winners will generally be notified either by email, telephone or post within 28 days of the closing date.
  13. Subject to confirmation by Promoter of the winner’s address and parental/guardian consent as may be requested, the winner will generally receive the prize within six to eight weeks from the closing date.
  14. No responsibility can be accepted for entries lost, delayed, misdirected, damaged or undelivered. Incomplete, inaudible and/or illegible entries will be disqualified. The Promoter shall not be responsible for technical errors in telecommunications networks, internet access or otherwise preventing entry to any competition.
  15. Prizes are as stated and are non-transferable. No cash alternatives will be offered. If due to circumstances beyond the Promoter's control, the Promoter is unable to provide the stated prize(s), the Promoter reserves the right to award a substitute prize(s). Prizes are subject to the additional terms and conditions of the manufacturer or supplier.
  16. Where prizes include trips, travel will take place in accordance with the dates and any restrictions specified and unless otherwise stated must be taken within twelve months of the competition closing date, subject to availability and excluding public holidays. If the date of any trip or event is in school term-time, the winner must obtain the prior written consent of their head teacher and their parent/guardian for the winner’s absence from school. Unless informed otherwise, winners and any guests are advised to obtain their own travel insurance and must hold a valid passport.
  17. The Promoter shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the winner (and/or any guests) under these Terms And Conditions if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation, war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes arising without limitation out of or in connection with:
    1. the activities of third party event organisers;
    2. any form of transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or cars); and/or
    3. by third parties providing accommodation included in the prize.
    For the avoidance of doubt, the winner (and/or any guests and/or parents/guardians) shall be solely liable for any additional costs incurred as a result.
  18. The Promoter shall not be liable to the winner and/or any guests and/or parents/guardians for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the competition and/or prize other than death or personal injury caused by negligence of the Promoter and/or the Promoters personnel and/or deceit or fraud by Promoter and/or Promoter’s personnel.
  19. In consideration of the entrants’ participation in the Promoter’s programme and/or live continuity links as part of the competition and/or prize (where applicable), each entrant irrevocably agrees and consents to the Promoter, its successors, assignees and licensees, to:
    1. participate in such programme and/or live continuity links as directed by the Promoter and consents to the recording of the entrant as an individual and the entrant’s voice as part of the entrant’s performance that may be incorporated into programme and/or live continuity links, in whole or in part, in the Promoter’s sole discretion and the entrant accepts that Promoter is under no obligation to use such performance and/or materials;
    2. the exploitation of the programme and/or live continuity links, in whole or in part, (including the entrant’s performance) by any and all means and in all media and formats whether known or hereafter devised throughout the world in perpetuity including without limitation cable and satellite television and websites;
    3. the use and reproduction of the entrant’s performance in the programme and/or live continuity links and the recording of the entrant’s performance, voice, image or any part thereof by all means and in all media and formats whether known or hereafter devised throughout the world in perpetuity for the purposes of advertising, publicity or otherwise;
    4. waive and release the Promoter from any claim, action or demand arising out of or in connection with the programme and/or live continuity links.
  20. By entering the competition, entrants acknowledge that they may be required to be used in publicity without further consent or payment. Such publicity may include without limitation the entrant’s name and/or likeness, voice, photographs and/or video footage of the entrant, biographical information provided by the entrants/winner and/or any statement made by them concerning the competition and/or the prize. Entrants agree that such elements may be used by the Promoter in any and all media in perpetuity throughout the world as the Promoter in its sole discretion sees fit.
  21. Any personal information collected by the Promoter in connection with a competition will be used in accordance with the Promoter’s Privacy Policy which appears in the section of these Terms and Conditions entitled ‘Use of Information’ (www.showcasecinemas.co.uk/nickfilmclub) or can be obtained by writing to the Promoter either by email at nickfilmclub@national-amusements.com or by post to the Promoter’s address marked for the attention of The Data Protection Officer. If entrants don’t want the Promoter to use their information in this way, entrants can tell the Promoter when entering the competition or at any time by writing to the Promoter as set out above.
  22. A list of winners for each competition can be obtained by sending a stamped addressed envelope together with details of which competition winners list you require to the Promoter within 30 days from the date of the closing date of such competition.
  23. Entrants agree to be bound by these Terms And Conditions. Entrants may be required to provide a written acknowledgement of all terms and conditions of the competition signed by their parent or guardian before receiving their prize.
  24. These Terms And Conditions shall be governed by and construed in accordance with the laws of England and the courts of England shall have exclusive jurisdiction in relation to any disputes arising therefrom.
